What is Process Service

   One of the most important steps of any Administrative or Legal procedure is Notification to the parties involved of their involvement, rights and responsibilities. Due Process of Law/Federal Regulations require that every party involved in a legal procedure must be informed of their inclusion. While the requirement for this notification comes from the Federal government, each State has their own laws regarding the details of the procedure. Process Service is the legal term for providing a person named in a court case with the required legal documents and instructions. Process must be completed by an unattached 3rd party. An Affidavit or Proof of Service must be completed confirming the party being served has been supplied with the necessary documents, notifications or instructions. Situations that may require a legal process service include divorce filings, civil lawsuits, trespass/no contact orders, subpoenas, witness notifications and other various legal actions.

Can You Serve Papers Yourself?

   If you are initiating a legal action, such as filing for divorce, custody or beginning a lawsuit, the law prohibits you from serving papers yourself. Generally, you may not be involved in the process service for any case to which you are a party. Since you may not serve papers yourself, there are other options. South Carolina law provides four means of process service:

  • A Private Process Server

  • Your county’s Sheriff’s Department

  • The U.S. Postal Service (when applicable)

  • Publications (when applicable)

Publication method is generally only used if personal process service cannot be completed in another manner.
